1. Agreement to Terms
These Website Terms and Conditions of Use (“Terms”) constitute a legally binding agreement between you and Guy Counseling (“Guy Counseling,” “we,” “us,” or “our”) governing your access to and use of guycounseling.com, including any content, functionality, and services offered on or through the site (collectively, the “Site”).
By accessing or using the Site, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Site immediately.
2. Changes to These Terms
2.1 We may revise these Terms at any time by updating this page. The “Last updated” date above reflects the most recent revision.
2.2 It is your responsibility to review these Terms periodically. Your continued use of the Site following any changes constitutes acceptance of those changes.
3. Description of the Site & Services
3.1 The Site provides general information about the counseling and life coaching services offered by Dr. John D. Moore, along with blog articles, resources, and tools to request an appointment.
3.2 The Site itself does not deliver clinical treatment or coaching. Counseling and coaching services are provided directly by Dr. Moore through scheduled sessions, either in person at our Chicago office or via a secure, HIPAA-compliant telehealth platform.
3.3 No professional relationship (therapeutic, coaching, or otherwise) is formed simply by browsing this Site, submitting a contact form, or exchanging preliminary emails. A professional relationship begins only after mutual agreement to proceed, typically following an intake process.
4. Not for Emergency Use
4.1 This Site, including any contact form, email, or messaging feature, is not monitored continuously and must never be used to report a medical or mental health emergency.
4.2 If you are experiencing a crisis, having thoughts of harming yourself or others, or facing a medical emergency, call 911 or go to your nearest emergency room immediately.
4.3 You may also contact the 988 Suicide & Crisis Lifeline by calling or texting 988, or reach the Crisis Text Line by texting HOME to 741741, both available 24/7.
5. Eligibility & Minors
5.1 This Site is intended for use by individuals located in the United States, and our clinical and coaching services are currently offered to residents of Illinois (for licensed counseling) and, where appropriate, more broadly for coaching services.
5.2 Individuals under 18 may not engage our paid services without appropriate parental or guardian consent, and individuals under 13 may not use the Site at all. By using the Site, you represent that you meet these requirements or are accessing the Site on behalf of a minor with proper legal authority to do so.
6. User Submissions
6.1 If the Site permits blog comments, testimonials, or other user-submitted content, you agree not to submit anything unlawful, defamatory, harassing, or that infringes the rights of any third party.
6.2 Please do not include personal health information, details of your treatment, or other sensitive personal information in any public-facing comment or submission — public comments are not confidential or secure.
6.3 By submitting content to the Site, you grant Guy Counseling a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating the Site.
7. Content Notice
Because our blog and articles address men’s health, relationships, and wellness topics, some content may reference sexuality, intimacy, or related mature subject matter in a clinical or educational context. This content is intended for adult readers and is not intended to be graphic or explicit in nature.
8. Appointments, Fees & Cancellations
8.1 Current fees for counseling and coaching services are published on our fees page and are subject to change for future appointments without notice.
8.2 Payment is due at the time services are rendered. We use Stripe as our third-party payment processor; we do not directly store your credit card information.
8.3 Appointments require at least 24 hours advance notice to cancel or reschedule. Appointments cancelled with less notice, or missed entirely, will be charged the full session fee, except in cases of genuine emergency, evaluated on a case-by-case basis.
9. Insurance
Counseling services may be eligible for insurance coverage where Dr. Moore is paneled with your plan; benefits, deductibles, and co-pays vary by carrier and are your responsibility to verify in advance. Life coaching services are not eligible for insurance coverage under any circumstances, as coaching is not a clinical or diagnostic service.
10. Privacy & Protected Health Information
10.1 Our collection and use of general website data (such as browsing information and contact form submissions) is governed by our Privacy Policy.
10.2 Once a formal client relationship begins, your protected health information is handled in accordance with HIPAA and applicable state law, and is governed separately by the Notice of Privacy Practices and Informed Consent documents you’ll receive at intake — not by this Site’s general Privacy Policy.
11. Intellectual Property
All content on this Site — including text, articles, graphics, logos, and images — is the property of Guy Counseling or its licensors and is protected by applicable copyright and trademark law. You may view and share content for personal, non-commercial purposes, but may not reproduce, republish, or create derivative works from it without our prior written permission.
12. Third-Party Links & Affiliate Disclosure
12.1 This Site may link to third-party websites not owned or controlled by Guy Counseling. We are not responsible for the content, accuracy, or privacy practices of any linked site.
12.2 Guy Counseling participates in the Amazon Services LLC Associates Program and may earn a commission on qualifying purchases made through Amazon links on this Site. The Site also displays third-party advertising.
13. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT. WE MAKE NO GUARANTEE REGARDING THE OUTCOME OR EFFECTIVENESS OF ANY COUNSELING OR COACHING SERVICES.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GUY COUNSELING AND DR. JOHN D. MOORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THIS SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THIS LIMITATION DOES NOT APPLY WHERE PROHIBITED BY LAW.
15. Indemnification
You agree to indemnify and hold harmless Guy Counseling, Dr. John D. Moore, and our respective contractors and service providers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
16. Termination
We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Site, other users, or us.
17. Governing Law & Dispute Resolution
17.1 These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles.
17.2 Before filing any formal legal claim related to these Terms or the Site, you agree to first contact us and attempt to resolve the dispute informally.
17.3 Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.
18. Miscellaneous
18.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Guy Counseling regarding use of the Site.
18.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
18.3 No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
18.4 Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
18.5 No Third-Party Beneficiaries. These Terms do not confer any rights or remedies on any person other than you and Guy Counseling.
